Terms and conditions for Chefs.studio.

Please read these Terms and Conditions carefully before registering for, accessing or using the Chefs.studio platform. By creating an account or by continuing to use the platform in any capacity, you confirm that you have read, understood and agree to be bound by these Terms and Conditions in full.

If you do not agree to these Terms and Conditions, you must not register for or use Chefs.studio.


1. Definitions

In these Terms and Conditions, the following terms have the meanings set out below:

  • "Chefs.studio", "the Platform", "we", "us" or "our" means the Chefs.studio culinary knowledge platform, operated by Ian McAndrew, Durham, UK.
  • "You" or "User" means any person who accesses, browses, registers with, or otherwise uses the Platform in any capacity.
  • "Account" means the registered user account you create in order to access certain features of the Platform.
  • "Content" means all text, recipes, articles, audio, video, images, commentary, Workposts, course materials, and other information published or made available on the Platform, whether created by us, by Contributors or by Users.
  • "Contributor" means any culinary professional, chef, educator, food writer or subject-matter expert who submits or publishes Content to the Platform under a contributor arrangement with us.
  • "Workpost" means a structured post type on the Platform used to share practical culinary knowledge, techniques, recipes, or professional commentary, typically created by a Contributor or a registered professional User.
  • "Sponsored Content" means any Content that has been produced or published in association with a commercial partner, sponsor or advertiser, which will be clearly labelled as such.
  • "Intellectual Property Rights" means all patents, trade marks, service marks, trade names, copyrights, design rights, database rights, know-how, and all other proprietary rights, whether registered or unregistered.
  • "Prohibited Content" means any Content that violates these Terms and Conditions, as further described in Section 9.

2. About Chefs.studio

Chefs.studio is a culinary knowledge platform created for professional chefs, serious cooks and food industry practitioners. It is designed to share practical, credible, technique-led culinary knowledge, drawing on the expertise of experienced professionals, including Michelin-starred contributors.

The Platform is operated by Mediamatic, a digital agency registered in Malta. Correspondence relating to the Platform should be directed to: [email protected].

Chefs.studio reserves the right to modify, suspend or discontinue any aspect of the Platform at any time, with or without notice, and shall not be liable to you or any third party for any such changes.


3. Registration and Accounts

3.1 Eligibility

You must be at least 18 years of age to register for an account on Chefs.studio. By registering, you confirm that you meet this requirement and that all information you provide during registration is accurate, current and complete.

We reserve the right to refuse registration to any person, at our sole discretion, without giving reasons.

3.2 Account Creation

To access certain features of the Platform, you must create an account by completing the registration process. You agree to:

  • Provide accurate, truthful and complete information during registration.
  • Keep your registration information up to date at all times.
  • Choose a username that does not infringe the rights of any third party, is not offensive or misleading, and does not impersonate any person or entity.
  • Not register more than one account per person without our prior written consent.

3.3 Account Security

You are responsible for maintaining the security and confidentiality of your account login credentials. You must not share your password with any other person. You agree to notify us immediately at [email protected] if you suspect any unauthorised access to or use of your account.

We shall not be liable for any loss or damage arising from your failure to maintain the security of your account.

3.4 Account Tiers

Chefs.studio may offer different tiers of account, including free and paid membership levels. The features, permissions and content accessible to you will depend on the account tier you hold. We reserve the right to change the features associated with any tier, or to introduce new tiers, at any time.

3.5 Account Termination by You

You may close your account at any time by contacting us at [email protected] or by using the account deletion function within your account settings, where available. Upon closure, your right to use the Platform ceases immediately.


4. Acceptable Use of the Platform

By using Chefs.studio, you agree that you will use the Platform only for lawful purposes and in a manner consistent with these Terms and Conditions. You agree not to:

  • Use the Platform in any way that is unlawful, fraudulent, harmful, or that facilitates unlawful, fraudulent or harmful activity.
  • Access or attempt to access any part of the Platform or any other user's account without authorisation.
  • Introduce viruses, malware, spyware, or any other harmful or disruptive code.
  • Use automated tools, bots, scrapers or scripts to access, copy or collect data from the Platform without our prior written consent.
  • Attempt to reverse-engineer, decompile or disassemble any software underlying the Platform.
  • Use the Platform to send unsolicited commercial communications (spam) to other users.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Interfere with or disrupt the integrity or performance of the Platform or servers connected to it.
  • Circumvent any security or access-control features of the Platform.
  • Harvest or otherwise collect personal data about other users without their explicit consent.

5. Viewing Content

5.1 General Access

Certain Content on Chefs.studio is available to view without registration. More detailed, technical and professional Content may be restricted to registered users or to specific membership tiers. We reserve the right to change which Content is freely accessible at any time.

5.2 Personal Use Only

All Content made available on the Platform is provided for your personal, non-commercial use only, unless you have entered into a separate written agreement with us for commercial use. You may not copy, redistribute, republish, transmit, broadcast or otherwise make available any Content to any third party without our prior written consent.

5.3 No Professional Reliance

While we take care to ensure that Content on Chefs.studio is accurate and produced by qualified professionals, it is provided for informational and educational purposes only. You should exercise your own professional judgement before applying any technique, process, recipe or advice to a commercial kitchen, foodservice operation or other professional setting.

We do not accept liability for any loss, injury or damage arising from reliance on Content published on the Platform.

5.4 Availability

We do not guarantee that the Platform, or any specific Content, will be available at all times or without interruption. We reserve the right to withdraw, amend or restrict access to any Content at any time.


6. Workposts

6.1 What Is a Workpost?

A Workpost is a structured content format used on Chefs.studio to share practical culinary knowledge, professional techniques, recipes, methods, commentary or insight. Workposts are typically created by verified Contributors but may also be available to registered professional users depending on their account tier.

6.2 Creating and Submitting Workposts

If your account tier permits you to create Workposts, you agree that any Workpost you submit will:

  • Be original work, or work for which you have obtained all necessary rights and permissions to publish.
  • Be accurate, truthful and not misleading in any respect.
  • Be your own work and not plagiarised from any third-party source.
  • Comply fully with these Terms and Conditions, including Section 9 (Prohibited Content).
  • Not infringe the Intellectual Property Rights of any third party.
  • Not include any advertising, promotional material or affiliate links without our prior written consent.

6.3 Our Rights Over Workposts

By submitting a Workpost, you grant Chefs.studio a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, publish, edit, translate, distribute and display your Workpost (in whole or in part) across the Platform and in associated marketing or promotional materials, with attribution to you.

You retain ownership of your own original Content, but by submitting it you confirm you have the right to grant us the above licence.

6.4 Moderation and Removal

We reserve the right, at our sole discretion and without prior notice, to edit, remove, refuse or decline to publish any Workpost that we consider to be in breach of these Terms and Conditions, inaccurate, misleading, inappropriate or otherwise unsuitable for the Platform. We are not obliged to give reasons for any such decision.

6.5 Accuracy and Professional Standards

Chefs.studio is committed to professional standards in culinary knowledge. You are responsible for ensuring that any Workpost you submit reflects accurate culinary practice and, where relevant, is consistent with food safety regulations and professional best practice.


7. Contributors

If you contribute Content to Chefs.studio as a named or verified Contributor, additional terms may apply to your relationship with us, which will be set out in a separate Contributor Agreement. In the event of any conflict between a Contributor Agreement and these Terms and Conditions, the Contributor Agreement shall take precedence in relation to the subject matter of that agreement.

All Contributors are required to disclose any commercial relationships, sponsorships or conflicts of interest that may affect the impartiality of their Content. We are committed to the editorial integrity of the Platform and will label all Sponsored Content clearly.


8. Intellectual Property

8.1 Our Intellectual Property

All Intellectual Property Rights in the Platform, including (but not limited to) the design, structure, layout, software, trademarks, logos, and original Content produced by or on behalf of Chefs.studio, are owned by or licensed to us. Nothing in these Terms and Conditions grants you any right or licence to use our Intellectual Property other than as expressly set out herein.

8.2 Your Intellectual Property

You retain ownership of the Intellectual Property Rights in your own original Content submitted to the Platform, subject to the licence granted to us in Section 6.3.

8.3 Reporting Infringement

If you believe that any Content on Chefs.studio infringes your Intellectual Property Rights, please contact us at [email protected] with full details of your claim. We will investigate all properly submitted notices and take appropriate action in accordance with applicable law.


9. Prohibited Content

You must not submit, upload, post or transmit any Content to the Platform that:

  • Is unlawful, defamatory, abusive, threatening, harassing, hateful or discriminatory on the grounds of race, ethnicity, gender, religion, disability, sexual orientation or otherwise.
  • Is obscene, offensive or pornographic.
  • Infringes the Intellectual Property Rights of any third party.
  • Contains false or misleading statements of fact.
  • Constitutes unsolicited advertising, spam or promotional material.
  • Contains personal data of third parties without their consent.
  • Is designed to harm minors in any way.
  • Facilitates or encourages any illegal activity.
  • Contains malware, viruses or any other harmful code.
  • Violates any applicable food safety, health and safety or consumer protection law.

We reserve the right to remove any Content that we, at our sole discretion, consider to be in breach of this Section, and to suspend or terminate the accounts of users who repeatedly or seriously breach these requirements.


10. Sponsored Content and Commercial Partnerships

Chefs.studio may, from time to time, publish Sponsored Content produced in association with commercial partners, sponsors or advertisers. All Sponsored Content will be clearly labelled as such and will be distinguished from editorial Content.

Our editorial standards apply to all Content published on the Platform. Sponsorship or commercial association does not entitle any partner to editorial control over Content. We reserve the right to decline, edit or withdraw any sponsored material that does not meet our editorial standards.


11. Privacy and Data Protection

We are committed to protecting your personal data in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR) as applicable in Malta and the European Union.

Our Privacy Policy, which forms part of these Terms and Conditions by reference, sets out in full how we collect, use, store and protect your personal data, and the rights you have in relation to that data. You should read our Privacy Policy carefully. It is available here.

By registering for and using Chefs.studio, you acknowledge that you have read and understood our Privacy Policy.


12. Cookies

Chefs.studio uses cookies and similar tracking technologies to improve your experience on the Platform, to analyse usage, and (where applicable) to serve relevant advertising. Our Cookie Policy, available here, explains what cookies we use, why we use them, and how you can manage your cookie preferences.

By continuing to use the Platform after being presented with our cookie notice, you consent to our use of cookies in accordance with our Cookie Policy.


13. Third-Party Links and Content

The Platform may contain links to third-party websites, services or resources. These links are provided for your convenience only. We have no control over the content of those external sites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

The inclusion of a link to a third-party site does not constitute an endorsement of that site or its content by Chefs.studio.


14. Disclaimers and Limitation of Liability

14.1 Platform Availability

The Platform is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, whether express or implied, as to the operation of the Platform or the accuracy, completeness or currency of any Content.

14.2 No Warranty

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

14.3 Limitation of Liability

To the fullest extent permitted by applicable law, Chefs.studio and Mediamatic shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profits, data, goodwill or other intangible losses, arising out of or in connection with your use of (or inability to use) the Platform or any Content.

Our total aggregate liability to you for any claims arising under or in connection with these Terms and Conditions shall not exceed the total amount paid by you (if any) to us in the twelve months immediately preceding the event giving rise to the claim.

14.4 Indemnification

You agree to indemnify, defend and hold harmless Chefs.studio, Mediamatic, and their respective officers, directors, employees, agents and licensors from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or relating to your use of the Platform, your Content, or your breach of these Terms and Conditions.


15. Account Suspension and Termination

We reserve the right to suspend or terminate your account, and to restrict or remove your access to the Platform, at any time and without prior notice, if we reasonably believe that:

  • You have breached any provision of these Terms and Conditions.
  • Your use of the Platform is harmful to us, other users or any third party.
  • We are required to do so by law or by a regulatory or governmental authority.
  • Continued provision of the Platform to you is no longer commercially or operationally viable.

On termination, all rights granted to you under these Terms and Conditions will cease immediately. Sections of these Terms and Conditions that by their nature should survive termination shall do so, including Sections 8 (Intellectual Property), 9 (Prohibited Content), 14 (Disclaimers and Limitation of Liability) and 17 (Governing Law).


16. Changes to These Terms and Conditions

We reserve the right to amend these Terms and Conditions at any time. Where changes are material, we will make reasonable efforts to notify registered users, for example by email or by displaying a notice on the Platform. The date of the most recent revision will be displayed at the top of this page.

Your continued use of the Platform after any changes have been published constitutes your acceptance of the revised Terms and Conditions. If you do not agree to the revised Terms and Conditions, you must stop using the Platform and may close your account.


17. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Malta.

You agree to submit to the exclusive jurisdiction of the courts of Malta in relation to any dispute arising out of or in connection with these Terms and Conditions, provided that we retain the right to bring proceedings against you in any other jurisdiction for the protection of our Intellectual Property Rights.


18. General

18.1 Entire Agreement

These Terms and Conditions, together with our Privacy Policy and Cookie Policy (and any Contributor Agreement where applicable), constitute the entire agreement between you and us in relation to your use of the Platform and supersede all prior agreements and understandings.

18.2 Severability

If any provision of these Terms and Conditions is found to be unlawful, void or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

18.3 Waiver

No failure or delay by us in exercising any right under these Terms and Conditions shall constitute a waiver of that right.

18.4 Assignment

You may not assign or transfer any of your rights or obligations under these Terms and Conditions without our prior written consent. We may assign our rights and obligations under these Terms and Conditions without restriction.
